Just an aggravation....

My daughter has had one failed jpouch surgery and one reconstruction. She is moving forward and doing good, she got married and had a very easy sit down job where she could use the restroom whenever she had to. She got laid off from that company and was getting unemployment benefits up until about a month ago. She registered with a temp service and told them of her medical condition. They found her a job at a factory and she decided to give it a try. Well, it was not the type of job where she felt she could go to the restroom as frequently as she needed to, so the next day she called the temp service and advised them of this. They were understanding, and next she called unemployment. She was told to file it as a sickness, so she did. Ever since that, they have denied her of the unemployment and now the unemployment's office wants a doctor's statement stating that she has restrictions. She called her family doctor and was told that her family doctor statement said she has no restrictions. So she decided to call her surgeon's office (which is about 4 hours away, and her surgeon is now retired). They want her to make an appointment, but there are no openings there at the time that I will be traveling there with her sister for her sister's scopes, in about two weeks!

Has anyone ever had this happen? What type of statement does a doctor give? I think that her having to use the restroom probably 20-30 times a day is a type of restriction. We have faxed the unemployment office a copy of her surgeons report from her surgery, I would think that would be plenty. I don't understand.

I am so proud of my daughter, she is now working at a small store and she got that job all on her own. It is tough some days, but she is managing it so far.

When she was younger, she did get disability until she turned 18, then they denied her of that. I feel for anyone who has to go through this stuff!

I think this is a misunderstanding of terms. From what I have gathered, from reviewing medical and Workers Compensation records, restrictions are regarding physical or mental conditions that specifically interfere with performing a job (like lifting, prolonged sitting, etc.).

This sounds more like an accommodation issue, meaning she needs a doctor's statement that she would need access to the restroom more often than the usual government mandated break times, but she is capable of handling the work itself.

But, it is possible that her need of frequent bathroom breaks could mean she would be ineligible for some jobs, like most manufacturing jobs where the line would need to be shut down if she has to go off line.

It's is very confusing, I don't understand why the unemployment office would need a letter/statement from the doctor, they have her last surgeon's medical notes. We have to go to Cleveland the first weekend in Oct. for my younger daughter then go back up there that following Fri, for my oldest! It's frustrating, but I will do what we need to. She had to actually see the surgeon because it's been a few years since her last surgery. I am hoping that he can write some type of statement. Do you know if there is a form they have to use?
